American citizens spend hundreds of hours in their cars each year. Although automobiles are an essential part of our lives, providing convenient transportation, they come with an unavoidable danger - automobile accidents caused by inattentive drivers, drivers who disregard rules of the road, and those who drive while drunk or intoxicated. Injuries range from minor to severe and even death.
Regardless of the severity of an accident, an experienced personal injury attorney can help you evaluate the appropriate amount you should recover from the at-fault driver's insurance company. Components of recoverable damages often include past and future medical bills, lost wages and earning capacity, mental and physical pain and suffering and loss of enjoyment of life. These components of damages vary from case to case, as no two injuries are alike.
If the defendant driver was intoxicated, the injured accident victim may be entitled to recover "punitive damages" in addition to the damage components referenced above.
For instance, we once represented a young woman whose car was rear-ended by a commercial vehicle, causing it to catch fire. While she did not suffer any burn injury, she was diagnosed with a cervical (neck) disc injury, but fortunately one not requiring surgery. She also suffered posttraumatic stress disorder from being trapped in the burning vehicle before bystanders pulled her out.
Blood test results revealed the presence of methadone in the truck driver. Investigation revealed that he was taking methadone pursuant to a physician's prescription. Suit was filed in federal court in New Orleans. The insurance company's last offer prior to trial was $125,000. Toxicology experts disagreed on whether the level of methadone in the truck driver's blood could have caused "intoxication" in the driver, as required to impose punitive damages for driving while intoxicated.
The jury awarded $500,000 in actual damages plus $1,500,000 in punitive damages. Thus, the jury disagreed with the testimony of the trucking company's toxicology expert, and it found that the methadone caused the driver to be intoxicated and that such intoxication was causally related to the accident.
Over the last few years, drivers distracted by cell phones, and especially texting while driving, have greatly increased the number of automobile accidents occurring each year. Injuries caused by distracted, negligent or intoxicated drivers range from minor injuries to catastrophic injuries such as neck or back injuries, spine injuries, brain injuries, burn injuries, paraplegia, quadriplegia, amputation or even death.
At McNamara Law Offices, we understand the family devastation and damages caused by serious accidental injury, whether the result of a car accident, trucking accident, industrial accident, offshore injury or maritime injury. We are experienced in helping accident victims recover what they are entitled to receive by law.
